Agreement to Terms

By accessing or using the ForkiePal smart fork device and companion mobile application (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Eligibility

You must be at least 18 years old to create an account. The Service is intended for use by parents, guardians, or authorized adults on behalf of children. By creating an account, you represent that you have the authority to do so.

Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to provide accurate and complete information when creating an account.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.

Acceptable Use

You agree NOT to:

  • Use the Service for any illegal or unauthorized purpose
  • Attempt to reverse engineer, hack, or tamper with the device or software
  • Share your account with unauthorized users
  • Upload malicious code or viruses
  • Interfere with the proper functioning of the Service
  • Violate any applicable laws or regulations

Product Usage and Safety

  • Supervision Required: Children should use ForkiePal under adult supervision.
  • Allergen Alerts: While ForkiePal provides allergen warnings, it is not a substitute for medical advice or vigilance. Always verify ingredients independently.
  • Not a Medical Device: ForkiePal is an educational tool, not a medical device. Consult healthcare professionals for dietary and health concerns.
  • Proper Care: Follow all care and maintenance instructions provided in the user manual.

Intellectual Property

All content, features, and functionality of the Service, including but not limited to software, text, graphics, logos, and AI algorithms, are owned by ForkiePal Inc. and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

User Content

By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your meal tracking data to improve our AI algorithms and food database. We will not share your personal data publicly without your consent.

Purchases and Payments

  • All purchases are subject to our Return Policy (see separate page).
  • Prices are subject to change without notice.
  • Payment processing is handled by secure third-party providers.
  • You are responsible for any applicable taxes.

Warranty and Disclaimers

ForkiePal devices come with a 1-year limited warranty (see Warranty page for details). THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORKIEPAL INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Indemnification

You agree to indemnify and hold harmless ForkiePal Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service will immediately cease.

Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes via email or through the app. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
